While US President Joe Biden eases immigration measures and moves away from the hard line of his predecessor Donald Trump, the country is experiencing a phenomenon rarely seen before: more jobs than job seekers.

This situation is partly explained, according to experts, by the fact that public aid to deal with the pandemic is much better than formal employment.

But how can Colombians who are thinking of emigrating to the United States take advantage of the situation?

Portafolio consulted Attorney Camilo Rincón, an expert in international legal assistance, visas and immigration processes to the United States, who commented that it is clear that the New Biden administration is much more friendly towards the migrant and this has led to several important changes in the immigration area of visas to the United States.

When talking about the possibility of working in the United States it is important to keep in mind that there are two different options: the first is that of visas that allow you to set up your own businesses in the United States and the second to go as employees”.

Rincón explained that for the first case are the L visas, for transfers; the E1, for merchants; the E2, for investment, or the one that President Biden has just reactivated for international entrepreneurs and focuses on visa options to start a company in the United States.

“The other option is to go as employees. There the most common visas are H1B, which are visas for workers with specialized knowledge; or H2 visas, which are for temporary workers and those are not necessarily going to require specialized knowledge”, accurate.

However, as Portafolio announced last April, appointments for U.S. visas could take until 2022.

“The drawback is that the embassy for reasons of the pandemic could not have the consulate open for almost a year, that is, it had very limited operations and although they did reactivate certain departments, the policy is to give priority to application processes that have made U.S. citizens who are asking their Colombian relatives. That’s the focus of the embassy: catching up on processes that made U.S. citizens or U.S. residents for their relatives“, he points out.

According to the expert these are some of the types of Visas that cover the main classifications of temporary nonimmigrant workers:

E-1 Visa: Treaty traders

The E-1 nonimmigrant classification allows a national of a trade treaty country (a country with which the United States maintains a trade and navigation treaty or maintains a qualified international agreement, or which has been considered a qualified country by law) to be admitted to the United States only to engage in substantial international trade on its own behalf. Certain employees of such person or a qualified organization may also be eligible for this classification.

E-2 Visa: Treaty investor

The E-2 nonimmigrant classification allows a national of a country with a trade treaty (a country with which the United States maintains a trade and navigation treaty, or with which the United States maintains a qualified international agreement, or which has been determined to be a qualified country by law) to be admitted to the United States when he or she invests a substantial amount of capital in a U.S. company. Certain employees of such person or a qualified organization may also be eligible for this classification.

H-1B2 Visa

Specialized professions related to Department of Defense Cooperative Research and development projects or co-production projects.

H-1B3 Visa
